CentralPets WebMail Terms of Use and Policies

CentralPets WebMail is provided to you ("user") under the terms and conditions contained in this agreement by The Central Pets Educational Foundation. By using this service you agree to be bound by these terms and conditions.

Description of CentralPets WebMail

CentralPets WebMail provides the user with the ability to send and receive electronic mail ("email"). This service is provided on an "as is" and "as available" basis without charge to the user courtesy of The Central Pets Educational Foundation. Free email accounts are limited to one per person or IP address and are also limited to non-commercial and other 'low bandwidth' users. For the purposes of these policies, accounts receiving hundreds or thousands of messages per day on an ongoing basis are not considered low bandwidth users. Free email accounts cannot be used for ffa, safelist, and similar uses since we consider this to be a commercial use. Additional accounts are available but they must be paid accounts by using the upgrade link from within the account.

CentralPets WebMail requires internet access from a computer with an internet connection and a suitable web browser. You are responsible for providing, and paying for, your own internet access including all equipment and software necessary to accomplish this.

Mailboxes

Users are given a maximum permissible mailbox size. This limits the total amount of mail that can be stored in a users mailbox. When this size is exceeded any additional email received will be returned to the sender with a notice that the recipient's mailbox is full. Users may upgrade their account to larger mailbox sizes and/or to enable other features for a fee.

It is the sole responsibility of the user to periodically delete email and attachments to help prevent the mailbox from reaching its size limitation.

Password Security

When you sign up for this service you select a password. It is your responsibility to protect and keep this password in such a way to prevent inadvertent disclosure to others. You may change your password at any time and The Central Pets Educational Foundation encourages you to change your password regularly.

Spam

Spam is unsolicited bulk email. You acknowledge that CentralPets WebMail uses techniques to block mail sent from known spammers. This service is designed to protect our users from receiving spam. CentralPets WebMail uses real time "blackhole" lists and other techniques to check and reject spam and mail from known spammers. In addition, filters and other techniques are available to the user to help block certain types of email.

Spam is not tolerated in any way by The Central Pets Educational Foundation. To help combat spam, The Central Pets Educational Foundation will immediately, and without warning, terminate the account of any user who uses the CentralPets WebMail system or their CentralPets WebMail address in any way for sending or promoting spam.

User Conduct

You agree that when using CentralPets WebMail you will:
a. Comply with all applicable laws and regulations.
b. Provide true and accurate information when signing up for a CentralPets WebMail account and that you will ensure that the information about you continues to be true and accurate.
c. Be solely responsible for the contents of all messages sent by you or stored in your account.

In addition, you agree that you will not engage in any way in any of the following prohibited uses:
a. Sending copies of any documents, and/or inclusion of works of others in violation of copyright laws.
b. Use the CentralPets WebMail system to harass or intimidate others or to interfere with the ability of others to use the CentralPets WebMail system or the internet.
c. Use the email system for any purpose restricted or prohibited by laws or regulations.
d. "Snooping" i.e., obtaining or attempting to obtain access to the files or email of others without authorization from the recipient of those files or email transmissions.
e. "Spoofing" i.e., constructing an email communication so that it appears to be from someone else.
f. Attempting to circumvent security measures or otherwise gain unauthorized access to email or other files.
g. Using the CentralPets WebMail system or your CentralPets WebMail address or the CentralPets.com websites in any way that harms, defames, degrades, or causes damage to the reputation or integrity of The Central Pets Educational Foundation and/or the CentralPets.com websites. Determination of said harm, defamation, degradation, and damage is at the sole discretion of The Central Pets Educational Foundation.

Privacy

Electronic mail is private correspondence between the sender and the recipient. The Central Pets Educational Foundation will not monitor, edit, or knowingly disclose the contents of a users email unless required to do so as follows:
a. Court order or law enforcement investigation may require examination and/or release of any document which may include email.
b. If necessary to enforce these terms and conditions.
c. To respond to claims that such contents violate or infringe on the rights of third parties.
d. To protect the rights or property of The Central Pets Educational Foundation.
e. As required to diagnose and correct problems and/or maintain the email system.

Modifications

The Central Pets Educational Foundation reserves the right to modify any portion of or discontinue CentralPets WebMail without prior notification to the user. The Central Pets Educational Foundation shall not be liable to any user or third party should it exercise its right to modify or discontinue CentralPets WebMail.

The Central Pets Educational Foundation may from time to time change or modify this agreement. This agreement is always available to be viewed online. Should you not agree with any changes or modifications to this agreement you may not continue to use the CentralPets WebMail service.

Termination

You agree that The Central Pets Educational Foundation may terminate and delete any webmail account where the user has not logged in at least once during any six month period.

You agree that The Central Pets Educational Foundation may terminate this agreement and your use of this WebMail service if The Central Pets Educational Foundation in its sole discretion believes that you have failed to comply with any of these terms and conditions.

You acknowledge and agree that any termination of this WebMail service under any provision of this agreement may be effected without any prior notice, and agree that The Central Pets Educational Foundation may immediately thereafter delete any email files stored by it for you.

Exclusions and Limitations

No conditions, warranties, representations or other terms are made or given by The Central Pets Educational Foundation concerning the availability or performance of this email service and The Central Pets Educational Foundation hereby excludes all such conditions, warranties, representations or other terms whether express or implied, arising by statute or otherwise, including (but not limited to) any implied conditions, warranties, representations or other terms of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement.

In particular, The Central Pets Educational Foundation makes no warranty that this service will meet your requirements, that it will be interruption or bug free, timely or secure; as to the results that may be obtained from the use of this service; as to the accuracy or reliability of any information obtained through this service; or regarding any goods or services purchased or obtained through or from this service or any transactions entered into through this service.

The Central Pets Educational Foundation accepts no responsibility for any unintentional deletion or failure to properly store any email messages on your behalf.

The Central Pets Educational Foundation accepts no responsibility for any costs or damages arising from any interruption, suspension or termination of this service.

You understand and agree that any material and/or data downloaded or otherwise obtained through the use of or from this service is done at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that might occur as a result.

Limitations of Liability

The Central Pets Educational Foundation shall not be liable (whether in contract, tort, breach of statutory duty or otherwise) for any indirect, special or consequential damages (including, but not limited to, damages for loss of profits, use, or data) resulting from the use or the inability to use this service, in respect of any goods or services purchased or obtained or messages received or transactions entered into through or from this service or otherwise arising out of this agreement even if The Central Pets Educational Foundation has been advised of the possibility of the same.

Except in relation to such liability as has been expressly excluded the maximum aggregate liability of The Central Pets Educational Foundation in contract, tort, statutory duty or otherwise (even where The Central Pets Educational Foundation has been advised of the possibility of such loss or damage) for any loss or damage whatever arising from or in relation to this agreement shall be limited to $50. This limit shall also apply in the event that any exclusion or other provision contained in these terms and conditions is held to be invalid for any reason and The Central Pets Educational Foundation becomes liable for loss or damage that would otherwise have been limited.

General

These Terms and conditions comprise the entire agreement between you and The Central Pets Educational Foundation and supersede any prior agreements, arrangements or representations relating to this service.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Arizona, USA, excluding its conflict of law provisions. User and The Central Pets Educational Foundation agree to submit to the exclusive jurisdiction of the courts of the State of Arizona, USA.

The failure of The Central Pets Educational Foundation to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.

If any provision of the terms and conditions is held by a court of competent jurisdiction to be invalid illegal or unenforceable, such provision shall be deemed to be deleted and the other provisions of the terms and conditions shall remain in full force and effect.

The Central Pets Educational Foundation's failure to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision unless acknowledged by The Central Pets Educational Foundation in writing.
